North Las Vegas Motorcycle Accident Leads to Death of 7-Year-Old Boy

Fatal Las Vegas motorcycle accidents are always tragic, and the feelings of loss when someone is killed in these incidents is especially deep when the person killed in such a crash is only seven years old.  Tragedy struck Las Vegas yesterday when a boy was thrown from a motorcycle he was riding with his Dad and was killed as a result of his injuries.  The boy was apparently wearing a helmet, but it came off when the boy was ejected.

According to reports, the accident occurred at around 6:40 p.m. yesterday in the 6100 block of Dawn View Lane.  The motorcycle was traveling north when a car that had been parked along the side of the road suddenly pulled out and attempted to execute a U-turn.  As a result of this apparently unexpected action by the car, the motorcycle crashed into it.  The boy, who was riding on the back of the motorcycle that his Dad was driving, was thrown over the car and traveled a shocking 22 feet in the air.

As stated above, his helmet came off while being thrown, and the boy landed on his head without his helmet attached.  Apparently, the boy’s helmet was not fitted for his head and even though he was riding behind his father, another child was riding in front of the operator.  Both of these circumstances are considered violations.  However, despite these issues, police did state that it appears that the vehicle failed to yield the right-of-way to the motorcycle.

First and foremost, our most heartfelt condolences go out to the family who suffered this unspeakable and shocking loss yesterday.  The family is certainly dealing with grief that seems insurmountable at this point, especially given the harsh reality that someone so young has been taken from them so soon.

Nevada Comparative Negligence

If the family of the child decides to pursue a Nevada wrongful death claim, the case would likely come down to Nevada’s rule on comparative negligence.  The police openly stated that the driver of the car was negligent, and the motorcycle driver was also negligent in allowing two passengers on the motorcycle and for not providing a proper helmet for the boy.

In Nevada, as long as the plaintiff family is seen to be less than 51% at fault for this tragic loss, they would likely recover damages as a result that could help to cover such costs as funeral and burial expenses.  In the sometimes-brutal world of the law, these issues can be very difficult to confront for the family who has just lost a loved one.  If this has happened to you, seek the help of a Las Vegas wrongful death lawyer who has the experience necessary to fight for the rights of those wronged by contacting Jack Bernstein & Associates today to schedule a free initial consultation.
