Thousands of children walk to and from school every day, and for the most part these students arrive back home safe when the day is over. Unfortunately for one local 11-year-old girl, the risks that every pedestrian encounters came to fruition this morning as she was struck by a vehicle while crossing in a crosswalk. She was taken to University Medical Center, and it’s believed that she has a broken leg.
The Las Vegas pedestrian accident occurred at 7:30 this morning in the 2800 block of Palomino Lane in front of Howard Wasden Elementary School. She was proceeding across the street in what appears to have been a lawful fashion when a white Honda that was traveling east on the road struck her. In what could be an indication that her presence in the crosswalk was not sudden or some sort of surprise, a witness to the accident stated that the girl was visible, which is why the other vehicle stopped before the crosswalk.

Fortunately, the girl will survive her injuries. Many people in Nevada are not as fortunate. In fact, an average of more than 50 people every year are killed in Nevada pedestrian accidents, which comes to an average of more than one person killed every week as a result of these types of accidents. In regards to the collision this morning, police cited the driver who hit the girl with failure to yield to a pedestrian in a crosswalk.
While this is a minor citation for the driver and would involve a fine in terms of a penalty, the driver could face additional liability by way of a Nevada personal injury lawsuit. If the girl was in the right by using the crosswalk, did not run out in front of traffic and was noticed by other vehicles, it seems that the driver could be found negligent if a lawsuit is filed, although other facts would need to be clarified.
